NEWSLETTER TERMS AND CONDITIONS

effective from 25 September 2018

1.1. These Terms and Conditions define the rules of using the Newsletter service.

1.2. The Newsletter service is provided by Firma Odzieżowa (Clothing Company) Barbaras Marcin Skowron located at Sztombergi 100, 28-200 Staszów entered in the registry of enterprises of Poland maintained the Mayor of City and Municipality of Staszów under no. 2405, with NIP 8661170743 and REGON 830275421, hereinafter referred to as "Barbaras".

1.3. If you want to use the Newsletter service, you need access to the Internet and an email address, but no other technical requirements need to be fulfilled apart from having a standard operating system and a standard browser.

2. DESCRIPTION OF THE SERVICE 

2.1. As part of the Newsletter service, Barbaras sends Users information in the form of an email (hereinafter referred to as "Newsletter") at the email address provided by the Users. The Newsletter service is provided free of charge for an indeterminate period.

2.2. The Newsletter contains information about Barbaras products, collections, ongoing actions and promotions, and other news about Barbaras and products offered in the shop, including opinions and press releases.

2.3. The User, by concluding an agreement for the provision of the Newsletter service with the Operator of the Service, provides their email address in the registration form in order to receive the emails mentioned above.

2.4. The provision of the Newsletter service shall commence when the Newsletter service agreement is concluded.

2.5 Every Newsletter contains:

1) information about the Sender of the Newsletter: Firma Odzieżowa Barbaras, Sztombergi 100, 28-200 Staszów,

2) subject field that describes the content of the Newsletter,

3) information about the way to unsubscribe from the Newsletter service or change the email address at which the Newsletter is sent.

3. TERMS OF USE 

3.1. The Newsletter service is free of charge .

3.2. The Newsletter service can be used by any person who provides their email address in the Newsletter part of www.barbaras.pl and clicks on "Subscribe". After clicking on the button, the provided email address is sent to the Service Operator and the provision of the Newsletter service commences.

3.3. Customers using the Newsletter service are obligated to refrain from providing illegal content, especially providing personal data of other persons without their authorization.

3.4. Emails sent as part of the Newsletter services are regarded as "works" within the meaning of the copyright law and are protected by the appropriate provisions of the law. Copying, modifying or using them in a way contrary to their purpose without the consent of the Service Operator shall be considered a violation of the law.

3.5. Newsletter is sent not less frequently than once every 7 days.

4. DURATION OF THE SERVICE 

4.1. The Newsletter service agreement is concluded for an indeterminate period.

4.2. The User has the right to terminate the Newsletter service agreement. The termination is effective immediately.

4.3. Users using the Newsletter service can terminate the service agreement by sending a statement at sklep@barbaras.pl or at the address of the Service Operator given in section 1 of these Terms and Conditions or by selecting the unsubscribe option on their Customer account.

4.3. Barbaras may suspend or terminate the Newsletter service after informing the Customers about this fact at the email addresses provided by them.

4.4. The Service Operator reserves the right to remove incorrect or non-existent email addresses provided by the Customer.

5. PERSONAL DATA

Personal data of Users is processed in relation to partaking in the Newsletter service.

Providing personal data and agreeing to partaking in the Newsletter service is voluntary. The legal basis for the processing of personal data of Users is consent and the processing of Users' data is in accordance with the Act on Electronic Services of 18 July 2002 (Dz. U. of 2017 Item 1219). Personal data shall be processed until the User revokes their consent. Personal data of Users shall be transferred to companies that provide Barbaras with information or legal services or provide marketing actions for us. We would also like to inform you that we do not transfer personal data to third countries.

5.2. Personal data shall be stored until the consent to receive the Newsletter service is revoked, and then based on the Administrator's legitimate interest (e.g. defending against claims).

5.3. Barbaras provides the persons whose personal data we process with the possibility to exercise their rights under the law, including the right to access their personal data, amend it, change it, remove it or move it as well as the right to request a restriction on the processing of personal data and to object to the processing in accordance with appropriate regulations. Persons whose data we process also have the right to complain to the President of the Office for the Protection of Personal Data.

5.4. Personal data of Users is protected by Barbaras from being seen by unauthorized persons and also from being revealed, lost or modified by unauthorized persons by using the appropriate technical and organisational precautions.

5. 5. In cases relating to the processing of personal data reported during the provision of the Newsletter service and not regulated in these Terms and Conditions, the appropriate provisions of the Privacy Policy apply. Our Privacy Policy can be found on www.barbaras.pl in the Privacy Policy tab.

6. COMPLAINTS 

6.1. Complaints about the Newsletter service should be filed at : sklep@barbaras.pl or at: F.O. BARBARAS Sztombergi 100,28-200 Staszów . Customers can also file complaints in person at the company's office.

6.2. In the complaint, please provide the claimant's details needed to inform the claimant about the resolution of the complaint, the description of the irregularities in the Newsletter service and the claims arising from the complaint.

6.3. Barbaras shall review complaints within 14 days from the reception of the complaint.

6.4. Detailed information about the possibilities Customers who are Consumers have when using out-of-court methods of filing complaints and seeking redress and also the rules of accessing these procedures can be found in the offices and on the websites of Regional and Municipal Consumer Ombudsmen, NGOs whose statutory tasks include consumer protection, Voivodeship Inspectorates of the Trade Inspection and at the following addresses on the website of the Office for Competition and Consumer Protection:

6.5. Customers who are Consumers have the following possibilities of using out-of-court methods of filing complaints and seeking redress:

6.5.1. The Customer may obtain free assistance as regards arbitration between the Customer and the Shop from Regional and Municipal Consumer Ombudsmen or NGOs whose statutory tasks include consumer protection (e.g. Consumer Federation or Association of Polish Consumers). Customers can call Consumer Federation free of charge at 800 007 707 or contact the Association of Polish Consumers at porady@dlakonsumentow.pl.

6.5.2. Customers have the right to request the Permanent Consumer Arbitration Court referred to in Article 37 of the Trade Inspection Act of 15 December 2000 (Dz. U. of 2001, No. 4, Item 24, as amended) to settle any disputes resulting from the sales agreement. The principles of organisation and operation of Permanent Consumer Arbitration Courts are defined in the directive of the Minister of Justice of 24 September 2001 on defining the principles of organisation and operation of Permanent Consumer Arbitration Courts. (Dz.U. of 2001, No. 113, Item 1214).

6.5.3. The Customer has the right to use out-of-court methods of complaint investigation and seeking redress in accordance with the procedure of Online Dispute Resolution developed by the European Commission and available at:

6.5.4. The Customer has the right to apply to the voivodeship inspector of the Trade Inspection, in accordance with Article 36 of the Trade Inspection Act of 15 December 2000 (Dz. U. of 2001, No. 4, Item 25, as amended), for an arbitration procedure in order to amicably settle disputes between the Customer and the Seller. Information about the rules and operation of the arbitration procedure conducted by the voivodeship inspector of the Trade Inspection can be found in the offices and on the websites of the appropriate Voivodeship Inspectorates of the Trade Inspection.
